These Terms & Conditions (the "Terms") govern your use of the websites, online programs, digital products, communications, and in-person coaching, clinics, rentals, and events offered by Boundary Waters Paddlesports Coaching & Conditioning ("Company," "we," "us," or "our"), including Boundary Waters Paddle Sports (https://www.boundarywaterspaddlesports.com) and Paddle Performance Framework (https://www.paddleperformanceframework.com) (together, the "Services"). By accessing or using any part of the Services, purchasing a product or program, or participating in an in-person session or event, you agree to these Terms. If you do not agree, do not use the Services.

1. Who May Use the Services

You must be at least 18 years old to purchase from, create an account, or access the Services. Minors may participate in-person programs and events only when registered by, and with the consent and supervision of, a parent or legal guardian, who accepts these Terms on the minor's behalf.

2. Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Purchases, Programs & Payments

Prices for programs, digital products, memberships, rentals, and sessions are listed on the Services and may change at any time. Payment is due at the time of purchase and is processed by our third-party payment processor. By purchasing, you authorize us (and our processor) to charge your selected payment method. For subscriptions or memberships, you authorize recurring charges until you cancel as described at sign-up or in your account.

4. Digital Products & License

When you purchase or access a digital product, program, or membership (such as mobility, nutrition, or sport-psychology content), we grant you a personal, non-transferable, non-exclusive, revocable license to access that content for your own personal use. You may not copy, share, resell, redistribute, or publicly post our content, or share your account access, without our written permission.

5. Refunds & Cancellations

Digital products and programs: Because digital content is delivered immediately, sales are generally final except where a specific refund or guarantee is stated on the offer at the time of purchase, or where required by law. In-person sessions, clinics, and events: Cancellation and rescheduling terms (including any deadlines or fees) will be provided at the time of booking, and no-shows may not be eligible for a refund. Rentals: Rental terms, deposits, late-return charges, and damage responsibility will be provided at the time of rental. If you believe you are entitled to a refund, contact us at the email below.

6. Health, Fitness & Coaching Disclaimer

Our content and coaching are evidence-informed educational and fitness guidance — not medical advice, diagnosis, or treatment, and do not replace care from a qualified healthcare professional. Paddling, mobility, strength, and conditioning activities carry inherent physical risks. Consult your physician before beginning any exercise, nutrition, or training program, especially if you have an injury, medical condition, or are pregnant. You participate at your own discretion and are responsible for exercising within your own limits.

7. In-Person Activities — Assumption of Risk & Release

Paddle sports and related on-water and land-based activities involve inherent and significant risks, including but not limited to capsizing, drowning, cold-water immersion, weather and water conditions, collisions, equipment failure, strains, sprains, fractures, and other injury, and in extreme cases death. By participating in any in-person session, clinic, rental, or event, you voluntarily assume all such risks and agree to follow all safety instructions and to use required safety equipment (such as personal flotation devices). For all in-person activities, you may be required to sign a separate written waiver, release of liability, and assumption-of-risk agreement. To the fullest extent permitted by South Carolina law, you release and agree not to hold the Company, its owner, instructors, and staff liable for injury, loss, or damage arising from your participation, except to the extent caused by our gross negligence or willful misconduct. Where a separate signed waiver exists, that waiver also applies.

8. Community Conduct

If the Services include community, comment, or messaging features, you agree to be respectful and not to post unlawful, harassing, infringing, or harmful content. We may remove content or remove users who violate these Terms.

9. Intellectual Property

All content on the Services — including text, graphics, logos, the "Paddle Performance Framework" and "Boundary Waters Paddle Sports" names and marks, photos, videos, programs, and downloadable materials — is owned by or licensed to the Company and is protected by intellectual-property laws. You may not use our content or marks without our prior written permission, except as expressly allowed by your license under Section 4.

10. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific result, performance gain, health, or fitness outcome from using the Services.

11. Limitation of Liability

To the fullest extent permitted by law, the Company and its owner, instructors, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Except for liability that cannot be limited under applicable law (and without limiting the assumption of risk and release in Section 7), our total liability for any claim relating to the Services will not exceed the amount you paid us for the specific product, program, or session giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless the Company and its owner, instructors, and staff from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Services will be brought in the state or federal courts located in South Carolina, and you consent to their jurisdiction, except where applicable law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" above and post the revised Terms on this page. Your continued use of the Services after changes become effective means you accept the updated Terms.
